Hello. I was with my boyfriend for 7 years, and during that time we lived together and shared all bills and expenses. I always trusted him because he was always very generous and never liked to spend on himself. He went to culinary school a few years ago and because he took out a private loan at that time, we were being gouged on interest. As such, I voluntarily took out a $25,000 home equity loan for a condo that I own, so that we could save about $400 a month on interest. In addition to that, long ago I let him be a signer on my AmEx account and we agreed that his share of my bill is about $10,000 now. I know I sound like an idiot for doing all this with someone who I was not married to, but I was being a bit lavish and irresponsible about money myself and we were enjoying a lot of luxuries based on this arrangement. We had an amicable breakup last month and we had made a preliminary verbal agreement that he will continue letting his paychecks be direct deposited into my bank account, and I will balance transfer one of them to him, and use one to pay down his share of the debt as fast as I can. The problem is, we live in San Francisco and he is having trouble finding a place to stay that is affordable (we had much cheaper rent together under rent control), and I just worry about his ability to pay me every month. I did some math about the cost to repay the debt based on what he can give me ($900 a month) and with interest, it would take up to 7 years to pay it down. I don’t think he can afford to keep that going with only $900 to live on (including rent) and so even though he has been great and attentive to this issue, its still a problem. We originally tried to get him an unsecured personal loan for the whole $35,000 so that he could just pay me back in one shot, but regrettably, since all the good credit was built up in my name and barely any in his, he was not approved.

We are meeting again on Monday to discuss any other possible options. I really don’t care about how long it takes to pay me back since interest would be paid by him, I am willing to take a smaller monthly payment just to make this sustainable, but I am concerned that in the future he could turn cold on me and just stop paying, or that he will have a new girlfriend sometime that will balk at the arrangement and encourage him to ***** me over or something.

At this time, he said he will sign whatever document I want in order to show that he owes me this money so I need to know what form that should be and whether we need to have it notarized to be legally binding. In the unfortunate event that he stops being a nice guy before the debt is paid, what would that document do for me? Would I have to go to court and spend thousands on lawyers to get him to pay in steady increments etc? I would **** to have to do that, both emotionally and financially, but I need to see what I am up against. Thanks for reading all this detail, any advice would be appreciated, and please try to refrain from making fun of my stupidity too much!

I have a 401k at my new job and I try to make a little money on the side, but don’t have a lot of time for that with a 3 month & 3 yr old. So, I’m working extra hard at the 9-5 to target a raise in the Spring. I just want some peace of mind, to be able to afford a haircut once a quarter and to see the possibility of home-ownership sometime…

Can anyone suggest a good plan?'>I have a Sep IRA from my old job that I do not and have never paid into that would cover my student loan and most of the rest of my debt. We are now living on credit, which started several years ago after job losses, medical issues, etc. Until a few years ago, our credit score was in the upper 800s so I still wasn’t worried. We are due a fairly large inheritance which would pay off our debt, but it is tied up in court and may be for years.

I don’t think credit counseling will work because, as I understand it, they help structure your debt so it can be paid off in 5 yrs. Even with zero percent interest we couldn’t do that.

I don’t know anything about filing bankruptcy; specifically, are we able to keep our house and 2 cars so we can work? I’m also worried about the 7 yrs. following bankruptcy, but if our inheritance comes through during that time, can we still pay off our creditors in full and erase the bankruptcy? How do we find a good bankruptcy lawyer?

I really need answers that focus on giving us guidance to get out of our predicament, not about how we got in it (which would make more sense if I was able to share ALL details). We have always been frugal (buying clothes at Good Will, etc.), so no lectures please.

We haven’t missed any payments yet (I’m having to use money from my 401k to manage everything), but our interest rates keep going up. We need to do something now before our situation gets worse. Help!
David M, we both work! How do you think we could manage this long if we didn’t?! I was laid off in a corporate buyout after 21 yrs. with my previous employer and took a $10k/yr. pay cut to get a job. I only make $40k, so that is significant, but I had trouble finding equivalent pay. (Now I’m happy just to have a job in this economy.) I work in the oil services industry and my husband for the airlines. Neither industry is doing well, so one of us losing our job is a real possibility.

Incidentally, we don’t have cable and many other luxuries. We don’t even have a washer, dryer or dishwasher. They cost too much in electricity, so we never bothered fixing them when they broke. Our central A/C went out late summer. We live in TX, so it will have to be replaced, but we bought 2 window units to get by for now.
Sorry, I noticed a typo above. Our credit score was in the upper 700s, not 800s (I wish!).'>We are in serious debt and I have no idea what to do.

Can anyone suggest a good plan? mae asked: ...

We are in serious debt and I have no idea what to do.
My personal belief is people should work for the betterment of one another, a system for the people by the people. A tribal mentality if you will; better described as democratic communism.

By eliminating internal markets and the notion of social-human value with the understanding that all life has value exceeding that of utility; and furthermore by emphasizing the value in ability and persistence, you can all but eliminate greed, pride, and prejudice. This is done in offering the same incentives to everyone who develops uncanny ability in any respective trade without regard to social status, creed, color, race, sex, sexual preference, or marital status on scheduled and random basis.

Furthermore democratic communism by no means eliminates the private sector, but instead eliminates the division between the government and private sector, with the exception of religion and or creed in there doctrine. Freedom in docttine leaves room for free speech and press, except, those with the intent to inflict malicious wounds regarding creed, color, race, age, *** or social status; such a social structure allows a metamorphosis to occur promoting the advancement of social enlightenment and production of ideas with insight.

Necessary goods and services should be distributed, with absolute equality, simply because a person’s contribution will ultimately allow others to do the same. We treat our children with such regard, why not our brothers and sisters?

Micromanagement in all parts is necessary, especially when financing prospective entrepreneurial endeavors. A system in which “grants” would be allotted to individuals or groups in a lottery as well as lists divided according to physical area and need. When a business is able to return the said “grant” the next individual or set of individuals would receive their grant(s). This places emphasis on the community to ensure the business is successful.

In such a social-economic system a political draft based solely on public input should be used to identify those who are best qualified for political positions. Then an election held in the democratic fashion would allow the people to select the person best suited for the position.

This system works internally as a communistic social economic structure but externally as a capitalistic market place.
@Houston, we have a problem

The incentives to excel are goods and services above what is necessary! You work hard you get promoted you get a bigger house more paid vacations, where you are not only paid for being absent but the trip would be paid for. Etc!
How did you come to that conclusion? The harder you work you get rewarded, incentives are allotted to those who show uncanny ability and persistence. This is not capitalistic! Essentially you work hard you get promoted. Necessary goods and services would be allotted with absolute equality, food, clothing, housing, school; college for those who partake in an intern work for tuition program, etc… this is communism. You work hard you get promoted, you don’t work you stay at base pay. There are people who want to be doctors because they can make a difference, people want to build houses. People who want to flip burgers! I know it sounds odd but I have meet them all.

By: Vindicated Vigilante

About the Author:

Matt S asked:

The right one WILL eliminate credit card debt. I know someone who has $80,000 in credit card debt and they are trying to do that to get rid of that debt! Is it really possible? Are there any restrictions in doing this. Can you ever get a credit card again if you do it?
If you file bankruptcy to eliminate all debt, do you have to give up ALL of your possessions? Will you have anything left?
This is for a friend of mine (really). They don’t own a home. They have 2 cars and some furniture and A 401k plan. Between the two of them they make about $40,000 a year. I don’t see how debt consolidation will help them How could they EVER pay off $80,000!?! They had a house but they used up all the equity in it over the years and sold it recently and broke even on the deal, ending up with NOTHING! What a mess! I just didn’t think they could wipe out their credit card debt! And, it really isn’t fair to the rest of us that pay our bills!'>Can an individual eliminate credit card debt by declaring bankruptcy?
