Hello. I was with my boyfriend for 7 years, and during that time we lived together and shared all bills and expenses. I always trusted him because he was always very generous and never liked to spend on himself. He went to culinary school a few years ago and because he took out a private loan at that time, we were being gouged on interest. As such, I voluntarily took out a $25,000 home equity loan for a condo that I own, so that we could save about $400 a month on interest. In addition to that, long ago I let him be a signer on my AmEx account and we agreed that his share of my bill is about $10,000 now. I know I sound like an idiot for doing all this with someone who I was not married to, but I was being a bit lavish and irresponsible about money myself and we were enjoying a lot of luxuries based on this arrangement. We had an amicable breakup last month and we had made a preliminary verbal agreement that he will continue letting his paychecks be direct deposited into my bank account, and I will balance transfer one of them to him, and use one to pay down his share of the debt as fast as I can. The problem is, we live in San Francisco and he is having trouble finding a place to stay that is affordable (we had much cheaper rent together under rent control), and I just worry about his ability to pay me every month. I did some math about the cost to repay the debt based on what he can give me ($900 a month) and with interest, it would take up to 7 years to pay it down. I don’t think he can afford to keep that going with only $900 to live on (including rent) and so even though he has been great and attentive to this issue, its still a problem. We originally tried to get him an unsecured personal loan for the whole $35,000 so that he could just pay me back in one shot, but regrettably, since all the good credit was built up in my name and barely any in his, he was not approved. We are meeting again on Monday to discuss any other possible options. I really don’t care about how long it takes to pay me back since interest would be paid by him, I am willing to take a smaller monthly payment just to make this sustainable, but I am concerned that in the future he could turn cold on me and just stop paying, or that he will have a new girlfriend sometime that will balk at the arrangement and encourage him to ***** me over or something. At this time, he said he will sign whatever document I want in order to show that he owes me this money so I need to know what form that should be and whether we need to have it notarized to be legally binding. In the unfortunate event that he stops being a nice guy before the debt is paid, what would that document do for me? Would I have to go to court and spend thousands on lawyers to get him to pay in steady increments etc? I would **** to have to do that, both emotionally and financially, but I need to see what I am up against.
